Cooking Kitniyot on 7th Day Pesach for Shabbat – Was there a problem?

Yes, I know Pesach has passed and now we are in the Yom Hazikaron and Yom Haatzmaut mood, but there was quite a lot of discussion due to what I wrote on IsraelB on Erev 7th day Pesach that: ‘the minhag was for Ashkenazim not to cook kitniyot on 7th day Pesach for Shabbat.’

Since writing that, I received quite a few messages from Rabbis and other people asking me why I wrote that.

The Psak I got:

Firstly, just to clarify. all the Halachot I write on IsraelB I check with Poskim I have access to. The main 2 poskim I ask are Ha’Rav Aryeh Shtern and Ha’Rav Raziel. In this instance I also asked Rav Shai from Ohel Rivka.

They all gave me the same answer – That the minhag of Ashkenazim is not to cook kitniyot on the 7th day Pesach for Shabbat.

Now for the debate – What’s it all about?

(This is based on my own research and not based on discussions I had with the 3 poskim mentioned above).

As we know Erev Tavshilin allows you to cook on Yom Tov for Shabbat.

There is a second concept of, ‘Hoil’ – Which as far as I understand means,if there is a possibility that people will come by and be your guests in this case on 7th day Pesach, you can cook extra food for them – Even though they were not formally invited beforehand.

For instance, if there would be a possibility that someone would pop in on 7th day Pesach afternoon who could have eaten kitniyot, then an Ashkenazi can cook kitniyot for them, due to the concept of, ‘Hoil’.

Let’s be clear, according to Halacha: An Ashkenazi could have cooked Kitniyot on 7th day Pesach for a Sefardi guest who was definitely going to eat with them or for a young child or ill person.

As I wrote in my guidelines, there was no problem with using Pesach kelim to cook or eat kitniyot on due to the concept of, ‘notem taam lifgam’, and therefore there would be no need to hagalah.

Also, you could have eaten chumus on the Shabbat following 7th day Pesach, as there is no problem in possessing kitniyot on Pesach.

Furthermore, Kitniyot are not mukzeh on 7th day Pesach, if you would be able to cook with them on 7th day Pesach, as some people think.

Ha’Gaon Ha’Rav Shlomo Kluger, Ha’Rav Shlomo Zalman Auerbach and Ha’Rav Osher Weiss all said it was permitted for an Ashkenazi to cook kitniyot on the 7th day of Pesach due to the concept of ‘Hoil’. Due to ‘Hoil’ they can cook the kitniyot on the 7th day in case a kitniyot eating person would come by and as they made an Eruv Tavshilin they could have cooked extra and eaten themselves the kitniyot food they had cooked the day before, the 7th day of Pesach on Shabbat.

But, as I wrote above the poskim I asked, as well as many others, said the minhag Ashkenaz was not to cook kitniyot on the 7th day. It could be for the following reasons: 1) They don’t believe ‘Hoil’ is a strong enough principle to enable to cook the kitniyot on the 7th day, 2) They only think ‘Hoil’ applies to where there is a strong chance you will have people who can eat kitniyot coming by on the 7th day of Pesach or 3) They believe the minhag of not cooking kitniyot on 7th day overrides ‘Hoil’.

I also think there are meta-Halachik issues here:

  1. The minhag is to be machmir on Pesach, and
  2. The trend of Ashkenazi poskim is to draw a clear distinction between their psak and the approach of Rav Ovadia Yosef -That Ashkenazim should go by the minhagim of Sefardim in Israel. As Rav Ovadia said, ‘ kama kama batil’.
